Project Decommissioning and Removal – Legal, Regulatory, and Technical Primer, presented by Charles Sensiba, Troutman Pepper, and Jonathon Kusa, Inter-Fluve, Inc.

To date, decommissioning of Federal Energy Regulatory Commission (FERC)- licensed projects has been relatively uncommon. We anticipate that project decommissioning and removal may become a more frequent occurrence as existing infrastructure reaches end of design life, there is heightened attention to dam safety concerns, and incentives to support decommissioning and removal that may develop.
We will review and update developments from the Uncommon Dialogue Process and recent legislation that may pertain to decommissioning and removal of projects.

Decommissioning of a licensed project involves specific steps, reviews, analyses, and preparation of documents. The complexity of the removal of a project can vary. A complex project can require the involvement of many technical areas of expertise.
In this presentation, we will discuss various considerations for the development of strategy, legal and regulatory considerations, and the planning and implementation of the technical aspects of decommissioning/removal of a project. Our review will include survey information from projects that have been decommissioned, as well as an interactive discussion with audience members.

This presentation share PG&E’s experience in developing a model to estimate hydropower decommissioning costs that was used to created a CPUC-approved accrual account.
